Land Acquisition Procedures

I would like to share with others on the Land Acquisition (LA) Procedure in execute the project in Malaysia. Example of past railway is extract for the benefit of everbody. Normally at least 66 steps are involved in most cases :-



    1. After finalising the design, ROW (Right of Way) is superimposed on to Land Acquisition (LA) plans by surveyor.

    2. Discussion with surveyor on needs of Unit Pengambilan Tanah (UPT) so as to suit UPT's format.

    3. Discussion with UPT and Land Office on any updatings of draft LA plans.

    4. Site visit with UPT to check in general, the physical status of the land

    5. Updating of LA plans at surveyor's office

    6. Submission of preliminary LA plans to Project Management Consultants (PMC) and discussions.

    7. Assisting surveyor on updating of LA plans based on PMC comments at surveyor's office.

    8. Preparation of finalised LA plans by surveyor.

    9. Submission of LA plans to Main Contractor (MC)

    10. Submission of LA plans by MC to PMC.

    11. Submission of LA plans by PMC to Government.

    12. Submission of LA plans by Government to Ketua Pengarah Tanah & Galian (KPTG).

    13. Checking and approval of LA plans by KPTG.

    14. Transmission of LA plans from KPTG to PTG / SUK / Pentadbir Tanah (PTD).

    15. Submission of LA plans by PTG to UPT.

    16. Detailed discussion with UPT after files are opened.

    17. Preparing Preliminary Report for UPT after site visit with surveyor.

    18. Purchasing of certified true copy of Land Titles (CTC) at PTD / PTG.

    19. Site visit with UPT Settlement Officer (SO) / checking surveyor's particular.

    20. Collecting CTC from PTD / PTG.

    21. Forwarding photocopy of Land Titles to UPT.

    22. Preparing Land Status Report (extract from CTC).

    23. Opening and Labelling files / subjackets for all the private lands.

    24. Checking Land Status with UPT officer.

    25. Preparing Form C for submission to State EXCO (MB) via PTG.

    26. Follow up with PTG for the submission to YAB Menteri Besar (MB).

    27. After approval by MB; file send back to PTG.

    28. PTG will take a few days and send back file to UPT.

    29. Preparation of Form D by UPT.

    30. Rechecking of Form D by UPt, which normally take another week and sending back to PTG.

    31. PTG approves and sends for checking by State Legal Adviser (LA).

    32. Legal Adviser will sometimes take a few weeks to check and sends back to PTG.

    33. PTG will send back to UPT.
    34. UPT will now send to Percetakan Nasional Berhad (PNB).
    35. PNB will type back all the data and will wait for the queue. This take 1 month.
    36. PNB publishes Form D into Gazette form.
    37. 10 days after gazette then only the documents can be purchased.
    38. Purchase the gazette documents and submits to PTG, UPT, Main Contractor, Jabatan Penilaian & Perkhidmatan Harta (JPPH) etc.
    39. Submission of A4 size plan for every lot to UPT and JPPH.
    40. Detailed report by having site visits with UPT's SO.
    41. Site visits with JPPH taking all photos of structures (normally not done on the same day).
    42. Prepares report for hearings; 4 volumes of detailed reporting of each lot.
    43. Finding addresses of all the landowners. Records at Land Office are outdated.
    44. Preparation of Forms E & F for all the lots and submits to UPT.
    45. Preparation of Planning Information Forms for every lot.
    46. Submission of Planning Information Forms to UPT for onward transmission to Majlis and then to JPPH.
    47. Submission of Forms E & F to UPT.
    48. Request of Form I by Main Contractor to PMC to Government to UPT.
    49. Preparation of Form I and Form K.
    50. To inform UPT on the progress of pegging works (demarcations).
    51. Pengarah Tanah & Galian to sign Form I.
    52. Discussion with UPT on dates for hearings.
    53. Serving of Form E / F to every interested party; owners / chargee / rentals etc.
    54. Serving of Form I & Form K
    55. Hearing for an average of 8 lots per day, usually in the morning.
    56. If there is slight doubt on the information say there is a doubt on owners / rentees etc to go on site again, then hearing postponed.
    57. Chasing JPPH so that valuation report is ready during hearing (normally cannot achieve target)
    58. If valuation report is ready Form G will be prepared within 2-3 weeks times, if not UPT will wait for another session until Private valuer submits its value and UPT will decide when government valuer is ready.
    59. Preparation of Form G and H by UPT.
    60. UPT submits Form G to Government and Government to prepare checques.
    61. After checques are ready sends Form H to landowners.
    62. PTD to issue Form J to building owner aftyer compensation received.
    63. Owner to move out from their premises (if voluntary).
    64. Use Enforcement to issue " Vacate Notice".
    65. Use Enforcement to demolish buildings
    66. Entry into lands.
